ATG NEWS RELEASE: Statement regarding Ninth Circuit ruling against Trump travel ban
Posted on Feb 9, 2017 in Latest Department NewsHONOLULU – Today the Ninth Circuit Court of Appeals upheld a nationwide injunction against President Donald Trump’s Executive Order dated January 27, 2017 banning travel from seven Muslim-majority nations and suspending refugee admissions.
Attorney General Chin issued the following statement in response: “Today’s 3-0 decision by the Ninth Circuit is a victory for Americans. Hawaii’s interests in stopping actions that discriminate against persons strictly based upon national origin and religion are protected for now, but this case is not over.”
Last Friday, February 3, the State of Hawaii filed its own lawsuit in the federal district court of Hawaii, alleging that the Executive Order violates the establishment clause of the First Amendment, denies equal protection of the law, and violates due process rights and other federal statutes. On February 7, Hawaii federal district judge Derrick K. Watson stayed the Hawaii lawsuit so long as the nationwide injunction remains in place.
