HONOLULU – The Hawaii State Department of Health (DOH) has filed a Notice of Violation and Order against the Maxima Bautista Trust for various solid waste violations occurring at 87-381B Hakimo Road in Waianae.

The property owner was cited for failure to remove accumulated solid waste, including approximately 50 junk cars, 20 cubic yards of scrap metal, 10 scrap engines, 200 scrap tires and 20-40 compressed gas cylinders. The property also housed several 55-gallon drums, including nine labelled “oily-water” and several more labelled “hazardous waste,” four 55-gallon drums possibly containing used oil with one bearing a “PCB” label; 350-gallon and 500-gallon tanks that may contain used oil, and at least 10 cubic yards of miscellaneous waste.

Based on site investigations conducted in 2016 and 2017, DOH imposed a penalty of $9,000 and ordered the property owner to remove all solid waste from the property, and to assess, and if necessary, remediate the property. The trust may request a hearing to contest the allegations or order.

DOH’s Solid Waste Section regulates standards governing the design, construction, installation, operation and maintenance of solid waste disposal, recycling, reclamation and transfer systems. Such standards are intended to prevent pollution of the drinking water supply or waters of the state; prevent air pollution; prevent the spread of disease and the creation of nuisances; protect public health and safety; conserve natural resources; and preserve and enhance the beauty and quality of the environment.
